Parties:
Country View Kennels (CVK) shall hereinafter be referred to as the “seller”. The original purchasing party, and solely the original purchasing party, shall hereinafter be referred to as the “buyer”.

 

Guaranteed Contract – Terms and Conditions

Death of Pet due to genetically caused disease or sickness:

  1. The seller guarantees the health of the pet for life of the dog.
  2. In the event of death of the pet within one year from its birth date due to disease, the seller shall replace the pet with another of equal value.
  3. In the event of death of the pet due to genetically caused sickness or disease, after the first year of birth, the seller shall issue CVK credit in the amount of 25% of the original purchase price of a replacement pet of equal value.
  4. The buyer is responsible for the daily health care and maintenance of the pet, including all immunizations and examinations recommended after purchase, as well as providing necessary medication and follow up treatments from all veterinarian visits.
  5. The value of the pet for purpose of this guarantee is solely the original purchase price and does not include any additional prices declared by the buyer, such as value as a show dog, etc.  This also includes any discounts declared by the seller.  Seller sells pets for companion purposes only.
  6. In the event this guarantee is excersized, the registration papers and this guarantee must be returned to the seller.

Death of Pet Due to Accident:

  1. The seller guarantees the life of this pet for a period of (8) years.
  2. In the event of the death of the pet due to accident, the seller will issue CVK credit in the amount of twenty-five percent (25%) of the original purchase price towards the purchase price of a replacement pet of equal value.
  3. In the event of death of the pet due to accident, a death certificate from a licensed veterinarian must be presented to the seller within (24) hours of the accident.

Pet Lost or Stolen:

12.  In the event that the pet is lost or stolen within eight (8) years from the date of birth, the seller will issue CVK credit in the amount of 25% of the original purchase price towards the purchase price of a replacement pet of equal value.

13.    In the event that the pet is lost or stolen, the buyer must advertise the lost pet in a major local newspaper for a period of one week starting twenty-four (24) hours after the loss.  In addition, the buyer must notify the police, Humane Society and animal Control of the loss.

14.    The buyer must present to the seller with copies of the police report, the advertisement, and paid advertisement bill in order to receive credit.

15.    In addition to the above section, the buyer must return this form to receive this guarantee. 

Fees:

16. In the event that any aspect of this agreement is contested, the seller is entitled to reimbursement to all costs and fees in defending that you have received such a certificate. 

Immunizations:

17.   In order to maintain the limited guarantees outlined herein, the buyer must have all annual immunizations done by a dually licensed veterinarian. 

Implied Warranties:

18.    The seller disclaims any and all warranties of merchantability and fitness. 

Limitations of Guarantee:

19.  This guarantee is non-transferable.  In the event that CVK discontinues, this guarantee is null and/or void.  The dog must be in good physical condition.  No replacement will be given if the female has been bred.  No replacement will be given if breeds that are known to be prone to hip dysplasia are over weight or over exercised.  No replacement if the registration application form has expired.  You must follow a licensed veterinarian’s recommended dog food program.  All dogs must not be over exercised during growth period.  All the above-mentioned conditions must be met or all guarantees above are void.  Licensed vet must do all laboratory verification.  The buyer is responsible for all costs from this day forward.  The seller is not responsible for any and all veterinarian expenses accumulated on replaced or returned dog or puppy.  Seller sells pets for companion purposes only.  No cash refunds.  CVK credit only.

19.    Agreement represents the total agreement between CVK and the buyer and no other terms or conditions shall be valid to this sale.  I, the undersigned, have read this agreement (2 pages) and agree to its conditions in full.
